Success for Paul Bogan in Privy Council murder appeal
22/07/2010
On 21st July the murder conviction of Kirk Gordon was quashed by the Privy Council. In what may well be the very last successful appeal from the Court of Appeal of Belize after the abolition of the right to appeal to the Privy Council, Paul Bogan successfully argued that the trial judge had misdirected the jury on the issue of provocation and that the appellant's police interview, in which he claimed to be acting in self defence, had been improperly withheld from the jury. A verdict of manslaughter was substituted and the case remitted to Belize for sentence.
